Dear Member, If either of the Acts are not applicable then go through the Minimum Wages Act, 1948 for payment of OT( sec 14).

Yes have done the same,my organisation is under the Minimum Wages act.in that case do we have to pay overtime,or can a collective bargainingbe arranged to make them agree to our demands of no overtime.

Dear, If the employer did not want to take O T work from the employees then the employees can not force him to give O T Work.If you want to take OT work then you will have to pay according to this Act. Limit of taking OT is also there in the Act.

But if collective bargaining is doen with the Union, then maybe they can agree to do overtime at our single rate of wages?
