Greetings to All Seniors,
1- Amendment of PF proposal for tax (TDS) applicability on PF withdrawal amount within 5 year service is applicable or not, if yes then what is limit for relief from tax? Whether it is 30000 or 50000?
2- whether New proposal of maternity benefit act 1961 of 26 weeks leave has been enacted or not? if yes then from which date has it been commenced?
3- Whether new amendment of Bonus act 1965 is encated or not, if yes then what is the date of commencement?
4- Should "Sunday and Holiday" be counted for calculating of 240 working days for the purpose of completion year under Gratuity Act 1972?
Please guide me appropriately.

Dear Mr. Gaur,
As per my knowledge, the answers as under:-
1.The applicability of Income Tax on PF withdrawal amount within 5 year service is very well defined under the Act. It will be applicable as per your income slab of financial year.
2. The proposal of maternity benefit Act 1961 of 26 weeks leave has been passed but so far state governments have not notified and it is under process.
3. The Payment of Bonus act 1965 has been amended and notified. Pl see your related state circular.
4. Now this Act has been amended and calculation of days have no meaning. After completion of 5 years, less the six month is none but more then six month is equal to an year.

All days of leaves including Sundays and holidays are counted as days worked.Even leave without pay or mere unauthorised absence is counted unless it is declared as break in service.See sec 2 A pf POG Act .
