Yesterday (03.11.2015) a conference (seminar) was organized by Labour Office at Delhi Secretariat.

Hon’ble Labour Minister Mr. Gopal Rai was the Chief Guest on the occasion. The programme was headed by senior official (DLC, ALC, Secretary, Commissioner) of Labour Dept of GNCT of Delhi.

In his speech the Hon’ble Labour Minister strongly insist not to abolish any Labour Rule. He count upon the various Contractor and Principal Employer to implement the Labour Welfare related Acts. The observations from various contractor also noted (issues related to Govt dept, PE).

Keeping in view the inflation speed, it is very difficult (almost impossible) to survive in the existing Minimum Wages. If we don’t obey the MW Act, how they will make their living. The following points mainly considered:-

Payment as per MW Act, 1948

Contract Labour (R&A) Act, 1970

Payment to Labour thru Cheque, ECS only (no cash payment)

Obtaining Labour Licence & Registration Certificate (if applicable)

Mandatory Compliance of Statutory Benefits

Uploading of Compliance Records at website (Contractor or PE)

Implementing various other payments (Bonus, Gratuity, W-off, Leave Encashment etc.)

The main agenda is how to monitor and implement the Labour norms for the menpower deployed thru various contracting agencies (Technical Menpower, Security, Housekeeping, Hospital & 4th Grade staff etc). It was a meeting where many points were raised for awareness regarding Labour Rights. The govt. may revise the L1 tendering process. The Statutory Compliance will be a must, as and when there will be any changes in the MW, the contractor price will also increased to accommodate the extra compliance cost.

The senior official from Labour Dept. notify all PE to strictly monitor the Labour Laws/norms of the contractor. The PE should timely release payment of the contractor. There should be no influence (from PE-Third Party) over the contractor regarding employment of labour at site.

Shortly Delhi Govt. may launch/implement notification thru which the implementation of Labour Rules will be a 100% mandatory, failing which will lead to serious / major action.
