Dear All,
we need to appoint some temporary workman in our factory for 180 days only with an agreement, after completion of 180 days we will discontinue him for three or more than three months for rejoining.
Please guide us for that practicing.

Please ensure that you issue an appointment letter for temporary workmen (Mention that in the subject heading). Mention his appointment on the following terms and conditions:-
1. That his appointment is for temporary period of six months from -------- to ------ on pure temporary basis. during this period, your services are liable to be terminated at any time without assigning any reason or notice.
2. Mention his consolidated salary inclusive of HRA.
3. Also mention that he will not be entitled for any other benefit available to the permanent staff/workers during the temporary period of his service.
4. Other general conditions of appointment letters normally remains same as that of other workers.

Under Delhi Shops and establishment Act if an employee who has worked for continuous three months has to be given notice period of 30 days before discharge. It covers temporary employee. Moreover under industrial employment standing orders if a permanent post has to be filled up preference has to be given to temporary employee.

First determine the office in which the person are to be recruited is registered under which enactment e.g. Shops and commercial establishments Act or Factory Act and the recruitment can not be violative of the provisions of the enactments applicable .........
If standing orders are applicable these can not be violated.......
