actually i want to know in my company a women has joined in mar-2011 but she has worked on contract based for 3 months till june now she has applied to be on payroll and as our policy we have taken her on 3 month probation.but she is pregnant and her due is nov.i just wanted to is she is eligible for maternity benefits under esic as she is holding esic card of previous company and she is saying to renew the same card as the card is valid for 6 month and she wants know whether she will b paid for 3 month leave..

Dear Friend
In order to get the maternity benefit the insured person has to work for 84 days before taking the maternity leave. Since she has joined in the month of July and going apply maternity leave from november she may work for more than 84 days, hence she is eligible for this leave.

this is the liability of the principle employeer to provide her facilities either she is on rolls of the company or contractor
