I am working in a Public ltd company, We have 36 days leave per year (no bifercation). As per co. rules we can carry forward 72 days leave (2 years). Excess leave to this will be encashed provided only if the employee has availed min of 15 days leave in that calender year. Else the excess leave will lapse.

We have a employee who had leaves to credit as on 1/1/09 = 72 days, he has availed till date only 6.5 days leave, & plans to take leave from 28/12/09 to 10/01/10 = 14days. (4 +10).
My query is, he will apply for this leave on 1st Dec09 and asks me to treat this leave of 14 days as continuous leave considering all 14 days as availed in current calender year as he will apply it on current leave card, so That he gets encashment of excess leave than to his credit.

Please guide as what actually shall happen in this case. Shall his leave be treated as 4 days from current year so that his total availed leave in this year is 6.5 + 4= 10.5 days where his excess leave gets lapsed.
