I am verymuch new in this forum and hope to learn a lot and contribute to this forum also. i work as a manager(HR) in a company now.

If any contractor worker dies due to naxalite shootout during his duty hour, will the case is liable for Workmen Compensation and if yes then whether contractor will pay the compensation or the principal employer? I think its not a case of accident.Pls suggest.

Dear Chittabrat,

Frist is welcom in HR Team,

As per the workmen compatation Act:If personal injury is caused to a workman by accident arising out of and in the course of his employment, his employer shall be liable to pay compensation.

If contractor will pay the compatation than well and good other wise principal employer is liable for the compatation.
