Default Notice Period- URGENT HELP

I saw your response in the citehr site. I thought, you will be able to help me out from the predicament that i am going through.

I had joined an organisation in August 2005, and the appointment letter stated terms of disengagement as three months notice or three months gross pay. When i completed the probation in july 2006, the letter removed the three months gross salary point. It only read three months notice. There was no communication about the change to anyone.

I offered to resign from the organisation on 15th December 2007, and offered to serve the three months notice period.But, they declined and asked me to hand over everthing by 31st December 2007. My salary was also stopped for the month.

As i was clue less, i walked out on 7th Jan 2008 and joined for my higher degree. But the organisation called up the institute and informed them that i am still their employee and i have not been cleared by the HRD.So, I came back by foregoing my admission for the higher degree.
When I came back, i offered to pay three months gross salary but it was refused. And i was asked to work for three months, for which i agreed. But i was not given any work for the past 2 and half months. I am sitting idle.

Now, I have been issued a notice by the organisation stating that I was to attend a event in December 2006, which i had not attended. And i have fraudulently claimed the money.The truth is that, I had taken an official tour of 20 days for which the event was also on the itinery. I did go and meet people there, but did not register for the conference as i had to move out for other official work as delegated to me.

Now, I am finding it all as harassment. Why dooes the organisation want to bring up an issue which had happened more than a year ago, and for the bills that have been audited.

Kindly help, what should i do now? Should I repond back to the notice. becasue i have only 15 days for the notice period to end. What if i do not repond back to it.

What if the organisation disengages me rather than relieving me? can i claim compensation? Can i file a defamation suit, for calling the educational institute and deamaging my reputation.?

Hi

Please take legal advise before you take any legal action.

If you have taken an acknowledgement of your resignation in Dec 2007, please preserve this carefully, along with any written communication where they told you to leave on 31st dec 07. This can be useful if a case is being filed.

w.r.t. the dec 06 issue, again check for any written documentation where you were asked to return from the event. If possible, contact the organizers and ask them if someone else was sent in your place, or if part of the seminar fees was refunded. This will again help prepare your defence.

Take a MOB and thrash the HR of the company , these people need to be dealt in their language only.

Dear ryan
Thank you so much for responding. I have got a copy of the resignation letter with the offficial stamp on it. I had asked for an acceptance letter , which they are yet to give( or may be they will not give)

As far as the event is concerned, I have not asked or claimed any money regarding the event, nor had i paid any delegate fee. I have only claimed only the local conveyance.

Should i respond back to the notice...or just walk out after the notice period.
