Default please guide me

Hi to all

Please help to solve this situation.

If a person who is on probation period leave the organisation by giving one month notice. And in that one month notice , that person does not come to the office. ( in Apointment letter it is mentioned that "During the probation period, if you decide to leave the Company’s services, you will be required to give one-month notice or pay an amount equivalent to one month gross salary in lieu of the notice. ")

can any action be taken by the company. Or what company can do in such situation.

Hi Vandana,

As it is already mentioned that he is required to give one month notice or amount in lieu of that..
If after putting the resignation, he is not reporting to office, then he must not be paid of the salary of these days.. moreover you must concern with his seniors, whether his services is required presently..
Moreover, if he is absent without any information, then you may issue a warning letter to him.. regarding joining the office in a short period of time. Because he might have joined some other company.. So take an immediate action..

Dear Vandana

The employee is clearly in breach of his service conditions. If you are really serious about taking action against him then you may file a civil suit against him and recover the amount of notice period along with suit cost plus interest. Whether your company will be willing to invest that much of time and resources ? Why don't just let him go and instead find out how to make your selection process more predictable and retention oriented.

In General, it is mentioned in service rules that during notice period the individual is not allowed for any leave except sick leave. if you are having any service rules then you can take the decision accordingly.

Further more you can ask for explanation from the individual.

Dear Vandana,

Its already mentioned in the appointment letter to serve one month notice pay without any leave. If the Person does'nt the company have the rights to hold his settlement amount, relieving letter and Experience letter. Ofcourse, this is equal to termination.

We did the same for the time being. We hold her settlement things for sometime.

Any comment on this action ??????
