Default breach of contract

Please advice

iam working in an year old company. We had one staff who entered into the company agreement for one month notice period on condition of holding 1st month salary. Now after 6 months he gave resignation for 20 days(on 28/1/07 to relieve on 15/2/0 notice period. Now that it is clear of not paying the holded amt..but confused whether should pay for the 15 days. And should we make payment of jan salary. I thought of getting advice thru cite hr.....pls advice.....

Dear Chandrima
If you have already hold his one month salary, then what is the harm in paying his Jan.salary?

Dear Chandrima
Since you have already hold his one month salary, please pay him the salary upto what period he has worked with you.
Is it clear to you?
