I have worked for a french based company in Noida for about 1.5 yrs. When i left , i didn't had a great relation with the HR.
Though there wasn't much issues , but she seems to be takign ti too far and now refusing me to assist me in withdrawal of my PF amount.
Is it necessary to have the PF withdrawal form to be signed by HR ? . The other person is also not going to sign as she and the company director have lot in common :cry: ...
Is there any other way to get my PF money without the intervention of my previous employer ?
I know about the legal suits but i dont want to go that way unless necessary.

it is mandatory that every employer has to sign the forms for withdrawl of PF failing which we can directly make a letter to PF authorities for not complying the procedure by the companies.
so i do suggest that u get form and fill it and send it by RPAD to ur compnay so that it may be a evidence for future correspondence and then after some time as i advised earlier do that.
I hope that u could get me.

If your present employer is not signing the withdrawal form then you can get the form signed by other A Grade official, the authentic designation which will be considered by PF Department mentioned on the back leaf of withdrawal form.
As per the present scenario I suggest that must have a visit with your form to PF office and meet with PR officer, he / she will make you understand the required necessary step in this concern. Because now a days you have to submit the SSN form also with your withdrawal form duly signed by the employer.
Hope above line will help you out.

not sure as to how do i confirm if the had sent my resignation info to the Pf deptt ...
I think i had to go the Pf offie ...
one more thing , my Pf was getting deposited in Noida ... so do i have to reach out to noida PF office or can i go to other Pf office as well i.e where my residence is ..Gurgaon

pls note that :
1. if ur compnay fulfill all the monthly challan and return of pf , and they have sent the resignation information to pf deptt. (form 10) u can withdrawl pf without signature of hr manager or owner of the company , u can attach the copy of bank statemnt shwing ur name and address and attest it by bank manager or any gazatted officer. and apply to the deptt.
it will take approx 2 month to credit in ur account.

Hi Aditi,
Yes , i do remeber the authroized signatories. ther were actually 2 people who signed , one was the director ( she has left the company long time back) and other is HR ( dont expect her to sign my PF documents , am sure she not gonna cooperate).

I think there should be a way to get my money back.
In any case , legal suit is always an option , fundamentally and legally , an employer cannot be reason for this being a gated issue.
I think i should go to the Noida Pf office and talk to the authorized person there.

You can get your claim attested with the bank manager, where you have account and send it straight to the local PF office in which your company contributes PF
