Default Unfair Practice in HR - Candidate suffering

Dear All ,

Kindly give me suggestion in this field .........

My friend is a NIT passout this year 2007 in chemical engg. and he was working with a leading Cement company few days before he got one opportunity from one of the leading profit making company in india at the time of his joining company HR reject him because of he was lacking 0.07% less marks in academics .now he is job less.
He is not wrong in any way because he has discuss and shown his marksheet to HR team at the time of written and interview.

kindly suggest him what he can do?
the company people decision is on hold from past 15 days.

please give your kind suggestions.

Dear Sender
Your friend can not do anything.
If certain company requires particular % of marks then candidates, who have secured the requisite % of marks will only be considered.
Please tell your friend that he need not loose his heart and hope and being just passed out, he will definitely get a good job.
Advise him to post his CV against advertisements for freshers and being with NIT lable, he will get a job soon.

Dear Sujata,
It is indeed unfortunate that your friend is in such a situation.
Was he issued a forml offer letter by the Company? What were the terms in the letter if it was issued?

If this happened after discussiong and showing the marksheets at the time of interview or even mentioning correct marks in the application form, then it is very unfortunate and unprofessional.

Normally, HR reads the application carefully to see whether the candidates meets criteria defined by the company's policy for recruitment this includes percentage and all.

During the interview process, the candidates is asked to fill up a form where he mentions details of marks obtained and all. This is reviewed by the interview panel and HR department during the interview. If the candidate is selected, the same is referred to approving authority for approval ofcourse with all details.

Based on the approval, the candidate is issued offer letter.

On joining the certificates of qualification, exp. etc. are verified with details mentioned in CV and application form.

If your friend has provided all the details correct and he has supported them with proofs, then he has every right to demand employment. If what you have described is true, then it is unethical on part of company to decline him employment.

Very interesting here is to know whether he was issued an offer letter. If issued, his case can be strong. If not, he still has moral right to demand employment.

Such cases are really painful. This creates bad impression of HR and organisational practices in the mind of people.

Your friend should speak to the senior most person with all details.

HI Sujata

Let your friend approach the new employer and propose them that" he will try to compete the remaining % by joining some relevant course in astipulated period of time. And if he is not able to they can terminate him". Many times such cases happen and this is one of the ways out where in both the company as well as the resource gets benefited.

I agree to Mr Hiten.Additionally ask him to find out if he can, that, was there any other reason to reject his employment? because as far as my knowledge goes ususally an employer does not decline the offer of employment just for mere 0.07% shortage of marks.If the company is so strict about this criterion then they would have rejected his profile at the first go.

Dear Sujatha,

It’s very painful decision.

I see that there are two possibilities in this case..


1)The company might have overlooked your friend’s mark list. While recruiting freshers, HR will definitely look for percentages first and
then only consider for written test or interview.
If they have overlooked, then this case should be considered as an eye opener for HRs. A small error but lot of mental trauma in an individual.

Or

2)You friend might have mentioned the round figure (regarding percentage) in the application form….
Ex : If his percentage is 69.93, probably he might have rounded it off to 70% which could be a little bit less than what company is looking for ( nothing less than 70% ).
In this case we can’t blame the company as they are following the standards. I request your friend to bring this point to HR.
If there is any possibility they definitely will consider.


Dear friend, remember one thing..... this is not the end of life, as a fresher he’ll have lot many opportunities. Provide him moral support, ask him to have faith and hope.

Hi Sujatha,

If your friend has a joining letter then I feel he should definately take the matter to higher authorities. He can write them a mail and request a time to discuss the issue. He must mention in the mail that "he has certain other offers and will like to take a quick decision about his career move." This is because it is very much possible that the company is keeping your friend as a reserve and at the same time also trying to search for other ppl. At the end if they find someone else they will hier that person otherwise will take decision in favour of ur frnd. Your frnd shld not become part of this trap and must force them to give their final decision at the earliest possible. Also, rather than completely relying on this particular job he should keep searching for other jobs.

thankyou for your valuable suggestions , as many of you asked he is having 64.43% . and He has the offer letter in his mail id i dont want to disclose the name of new company but earlier he was working with ambuja cement limited.

so john please give me your mail id so i may forward his CV to you, he is basically from kerala and willing to relocate at any part of india.
