Adjustment of notice period against accumulated earned leaves
Hi in my present company as per the hr policy they have mentioned that : notice period waiver is first adjusted against the accumulated leave balance if any of the colleague. the remaining accumulated leaves will be encashed as part of f & f settlement. however if the accumulated leave balance is insufficient for adjustment against notice period waiver the colleague will compensate the company as stated in c above. currently my notice period is 90 days and i have around 20 earned leaves in my account. when i talked to my manager regarding my last working days and regarding adjustment of earned leaves against the notice period he denied saying that the leaves will not be adjusted against the notice period and this is the instructions from the higher managment. now when there is a policy that notice period waiver will be first adjusted against the accumulated leave balance how they can do this ? is higher management above the company hr policy. please tell me is there any way i can legally fight with them on this ? regards manoj
Company sent me a demand notice to pay for notice period
Hi i was working as a manager in a corporate office in delhi. as per appointment letter notice period is 2 months. i have resigned and did not serve notice period. company sent me a demand notice to pay notice period after 6 months. company calculated notice period on the basis of gross salary basic hra spl.allowance and adjusted earned leave on the basis of basic salary only. now company is not clearing pf withdrawal form form 16 etc. please advise : 1. what is the legality of the notice period for officers in corporate. 2. is the notice period and leave encashment can be calculated on different basis which only benefited employer. 3. can i withdraw my pf without attesting from company and how. 4. how i could file a income tax return if i do not have form 16. thanks & regards vineet gupta
Earned leave / sick leave compensation against notice period.
I am working with an engineering mnc registered in mumbai ihave resigned and serving notice period of three months. i have 54 earned leaves 30 sick leaves and 7 casual leaves. i am told by my superiors that i cannot surrender my earned leaves against notice period for reduction in notice period and at the same time i cannot avail the earned leave also. in our company the earned leave cannot be compensated by cash and it can be carry forwarded for two years. please guide that is there any policy of government for earned leave compensation. can i take any legal recourse if i am not allowed to surrender my earned leaves or sick leaves against notice period and also not allowed to avail the earned leave during notice period.
Notice pay
Dear all can you please tell me if a person who leaves the company a restaurant chain in this case and wishes to get his pls earned leaves/ priviliged leaves adjusted against his notice period is entitled to service charge s.c. is the variable amount and is given to the staff as an incentive on the amount of sale he didn t take the pls but wanted it to get adjusted against the notice period of 30 days and his hod agreed to it owever my question now is that his salary for the last month needs to be processed and though he would have only got basic pay for the no. of pls he had in his account in case of pl encashment company is ready to pay him his full gross salary but the employee wants the complete salary along with the service charge could you please let me know what would be right course of action in this case? is company liable to pay him the s. c. amount since he didn t come to work even for a single day during that month....
Leave during notice period - hod is saying i can't take earned leave
Hi.. pls guide me. i resigned from the company on 9th august 10th august it was accepted by the manager. 12th august i returned from the project site of ujjain to delhi where my base location is. now i applied for 14 days of earned leave which was available. hod is saying i can t take earned leave and have to go back to ujjain. i came from ujjain after written permission. please guide me if i am right or not in taking earned leave during the notice period. company policy on leave and notice period is silent on this.

Dear all this is about earned leave/pl. after completion of 240 days will get 16 pl s as per our company leave policy. if an employee wants to apply for leave can she/he use earned leave el? how many earned leavesel /previlege leaves can avail to take leave at a time in a month. encashment of el done on what basis? is it encashed on basic pay /net pay? if encashment is on net pay/basic how it is calculated current year pay? please share your knowledge. thanks aneetha
