Dear Sir/Madam, A Company is having Regd Office in Delhi and having Branches in other States like UP,Maharashtra,Rajasthan etc. Comp is regd under PF and ESI. Minimum Wages as prevailing in Delhi are applicable to the Employees working in Delhi. Now pl clarify if Min Wages will apply state-wise to the Employees working in other States OR Min Wages of Delhi will apply to all Employees as we are Delhi based Company irrespective of the work place of Employees. If sub-codes are allowed in PF Statewise as in case of ESI ?

Dear colleague,
Minimum wages of the respective states and concerned employments as per schedule attached to the state acts/rules as well as skill category of employees will apply. Pl check the respective state's min wages act /rules.

1. As per law State minimum wages are required to be paid in the state where the employee is posted/located & working.
2. However, you can also pay Delhi minimum wages if they are equivalent to or are more than the state of posting of employee.
3. If you transfer the employee from the one state where minimum wages are X+1 to a state where minimum wages are X, then in that case you have to continue paying X+1 to the said employee. You cant reduce wages which he is already drawing.
4. If you transfer the employee from the state where minimum wages X to a state where minimum wages are X+1 then in that case you will have to pay X+1.
