Hellow all, My Company is a private company, which is carrying on a manufacturing activity. We are registered under Shop and establishment act, however we have not taken a licence under factories Act, 1948. I want to know what are the effects of the non registration under Factories Act? Also can we apply for the licence now?

Dear sir,
If you have engaged 10 or more persons and manufacture products with aid of power or 20 persons working without aid of power , then a License under factories Act is must to have and same needs renewal on its expiry timely. Not having a valid license is punishable for carrying out illegal activities .Registration under the Shops and Establishment Act is not meeting compliance .Please write above details at my mail address below for further advice.

Non registration in Factories Act, will lead to multi-faced fines and penalties. The penalties in the act are divided in sections ranging from general offenses and leading upto contravention of individual offenses. See this Penalties and Procedure Under Factories Act 1948
