What is the status of Probationers & trainee under payment of Bonus Act. Are they entitled for the same. Is the employee entitled for the same from date of joining or from Date of Confirmation????
Trainees are not employees, they will be eligible for Ex-gratia. IT depends upon company to company, there is no rule that ex-gratia to be paid and that too to Trainees
Probationers are eligible for bonus , they are employees on observation
Probationers are eligible to what is due for normal confirmed employees
According to law there is only one type of trainee, that is Apprentice Engg. Apart from this on legal ground there are no other type of trainees.
If you are deducting PF from the salary of these trainees then they are employee (as per law) of your organization and if they have Basic+DA less than or equal to 10000 then they are eligible for bonus.
Probationers are elegible for bonus if they fall under the elegibility criteria.
