Insisting for resignation after 20 years of service based on low performance
Dear all please guide what i can do or is labour court will justify. i am working in xyz removed for privacy. pvt. ltd in mumbai. since company is loosing jobs and only 23 jobs in hand has stated removing employees based on performance. i am with xxxx since 20 years & now xxxx is insisting me to resigning based on low performance . but company never given me in writing about my low performance also i was assigned jobs till date. also company is affording to recruite some in piping electrical etc. alos some employees has been working still after retirement please help me is i refuse to give resignation . regards

My pvt ltd firm has suspended its operations for time being and is operating under a new partneship name. they plan to dissolve the old pvt ltd firm and start a new one with the same directors. all this involves change of name ex: 1. abc pvt ltd 2. xyz partnership firm 3. mno pvt ltd now there are some employees who are working with the firm when it was abc pvt ltd and is operating as a partnership firm. my question is are we in probation now that the firm s name is different? and will we be in probation again when the new company is formed? is probation period applicable to hr admin and manager as well?? kindly advise thankyou ria nath puri
'transfer of employee from 'a' pvt company to 'b' pvt company , mgmt - directors remains same.
This is my query we have two pvt companies registered and the directors for both the companies remain same . from 'a' pvt company we have to transfer an employee to 'b' pvt company can i just give a transfer letter or do we need to follow the resignation procedure and issue new offer letter from 'b' company there is only designation and change in nature of work . salary remains same. as we are start up there is no pf & gratuity for now. please guide on the documentation procedures to follow .
Gratuity - proprietary company and after 3 years of joining they have registered as pvt ltd
Last month i have resigned from a company where i was worked for 6.5 years. when i joined the company it was a proprietary company and after 3 years of joining they have registered as pvt ltd and asked to resign from proprietary and fresh appointment letter was given from pvt ltd and i have served 3.5 years in pvt ltd. after resignation when i asked for the gratuity they denied and saying you have not completed five years. is this true? no settlement has been made while moving from proprietary to pvt ltd.
