Dear Seniors,
I have a doubt that if an employee is terminated from the company for his/her non performance on an immediate base will he/she be eligible to get the re-leaving letter from the company.i request to kindly clarify the doubt ASAP.

Hello Ms Mamatha,
If the services of an employee is terminated on non-performace of work, then why to insist on getting relieving letter because I am sure if the letter is given to the employee, the employer is surely going to mention the reasons, which will not be in good taste for further and future employment.
Though it is not denied that the employee is entitled to receive the relieving letter.

Hi Mamatha,
Are you referring to termination letter? Many organizations, in-spite of terminating an employee will issue experience and relieving letter, considering the future of the employee. It is better to clarify the same with the HR department.

In my view you should give him experience letter,where you don't have to mention the performance.
The relieving letter in this case would be negative for the person while experience letter would create a win win situation for you and the employee as well.

Apart from the above views and their comments, if an employee is terminated then termination letter itself is relieving letter there is no need to ask for separate relieving letter. As commented above please speak to your company and avoid getting termination letter which may hamper your career ahead, hence ask them to accept your resignation letter of back dated instead and get your experience/relieving letter in a mutual understanding
