Few gratuity query
Dear seniors i have few query related to gratuity 1. suppose an employee works for 11 year continous service in any organisation can he take gratuity twice say after 5 year and then after next year . 2. can we count notice period for entitlement of gratuity during full 7 final settlement. 3.i have seen various comment some say person should have worked for 5 year for gratuity entitlement few says he should have worked for 240 day in 5th year which one is correct as per statutory provisions.big confusion. 4. what is the purpose of gratuity insurance because in few ctc structure gratuity as well as gratuity insurance both are part of ctc. . regards

Want to know about gratuity payment. if gratuity is mentioned in the ctc and employee completed only 3 years of service and resigned. can gratuity be paid at the time of full and final ?
Payment of gratuity
Dear hr members this is a case study related to payment of gratuity of an employee who is absenting from the work place since four months. we have issued 34 letters. he has replied only first letter showing that he is sick & on bed rest. after that he has not replied any letter. the management has finally decided to run separation action treating him abandoned the services at his own. what is the last date for calculation of gratuity payment whether the last date of working or final letter issue date i.e. after 34 months of actual working date. pls. share your views as per payment of gratuity act in up. regards haubey
Eligibility for gratuity in full and final settlement
Hi i was working with a section 25 company from may 2007 to sept 2013 and have worked with the company for over 6 years of continous service. however all employees of the company including the ceo are on full time long term contracts. i was initially given a 3 year contract in 2007. at the end of 2 years company renewed my contract for a further period of 5 years. there has been no break in service and no interim full and final settlements were done. however the company says that i am not eligible for gratuity payments as i and other employees had worked with the company on a contract and hence gratuity is not part of the full and final settlement. kindly let me know whether i am eligible to receive the gratuity and if so what are the steps i should take to ensure company pays me the gratuity. regards nidhin
