Hello All,
I am working in small org with 34 employee
but this org neither have registration in
Shop & Establishment or in PF, ESI also does
Not provide the bonus to employee,
Pls let me know why labour law authority
Doesn't initiate to penalise such org where
Labour law rules are being openly voilate

1. Sir, you have not mentioned in the remarks in what type of organisation you are working ?. Whether it is a factory or an establishment ?

2. Coverage under various labour laws is separate depending upon the provisions contained in said labour laws. If any establishment is coverable under any labour law, then it is to be covered from that date from which it engaged minimum numbers of persons as required in said labour law.

3.In order to reduce complaints regarding "Inspector Raj", various Governments including the Central Govts. have imposed various conditions/restrictions on its officials regarding their visits to such smaller establishments. This may be one of the reasons that many time, the establishments succeed in non-implementation of various labour laws in their units. In case, you deem fit, you can take up the issue with various State labour concerning authorities including Central labour enforcing authorities on issue of enforcement of various labour laws in your establishment including law relating to bonus.

Probably your organisation needs to registered under state Shops and Establishment Acts. Violation of labour laws can be brought to notice of laical labour authorities for necessary action.

Yes sir,
Our org should be registered in shop & establishment act, also in EPF, ESIC,
But inspite having employee 34 in org

None of goverment authority has taken
Any action against such org,

Do not worry why labour officer is sleeping.
You be bold enough to take discreet action by writing to labour officer.Remember your company will not like it.
If PF is not being given go to nearest EPF office and complain.
Same thing with ESIC.
Bold but discreet action as you feel fit.

Mr. Anonymous,
When your organisation has not approached the labour law authorities for registration and none ele has also reported about its exitence, do you expect that the existence of your organisation should atomatically have come in dream of the labour law authorities, unless some one brings in to their knowledge about violation of labour laws?
So, if you feel yourself in an awakened state, why don't you take initiative to wake up the sleeping labour law authorities by providing complete details of violations of labour laws by your organisation? You should not expect that unconcerned others should make the authorities awakened on behalf of some anonymous person without knowing name of the organisation, place and incidents of violation, even when the very much concerned person (yourself) don't have the courage to report the incident to them.
BETTER TAKE SOME INITIATIVE THAN PLAYING BLAME GAMES. Solution to your question lies in your own initiative.

Now a days Inspector Raj became sleepy due to the policy of Government for the promotion of establishments and for providing employment to the unemployed persons.
In case any person affected by the establishment policy, he can approach the Authorities of Labour Dept. for justice. Then they will interfere for implementation of Labour Law.

Dear Mr Sachin,
You have not given any information about you and neither informed pertaining to roles you are into.I have now reasons and some one like me will attempt to assume spotting you doing negative roles there in the organization.

My advice to you may not give you any pleasure rather that may try to awaken others and you in similar problem situations after some time relief and a feel of professional comfort in same place.
You are working in this organization right. Instead of waiting Inspector to come and prosecute, you being a paid man of organization, go and advise your Director that are aware of violation of certain provisions which is offence and punishable with penalty and prosecution.And that needs approval/ go ahead in terms of concrete action.
If you are responsible for Labour Law compliances, prepare a document, go and discuss the applicable provisions and get his acceptance/ concurrences on each issues.You will find that many portions of suggested jobs are without cost and you then comply actions.Every home ,city, country , organization has certain areas to improve upon and it is we who must encash this opportunity to prepare action plan , start doing them .....

We all have grown like this as above!!!
I discourage idea of watching arrival of any unwanted being to set right or any INSPECTOR whoh will come and go all the times.
