Hello seniors, Our state minimum wages is 7200 PM Pls guide can we pay wages less then Minimum wages as applicable in state, Regard Kumar

Dear Kumar,
You can not pay wages to any class of employees under the scheduled employment less than the minimum wages fixed by the App. Govt for it is a punishable offence with fine or imprisonment or with both as per Sec.12 of the Act. Apart from this, if any claim is filed by the aggrieved workman or union or an inspector under the Act u/s 20 before the Authority, sec.20(3) empowers the Authority to impose compensation of a sum not exceeding 10 times of the amount of difference claimed. The Supreme Court had categorically observed some 50 years ago to the effect that no employer has the right to remain in the industry if he could not pay the minimum wages to his employees.

Sir... i have seen so many stablishment Which is openly paying wages less than The minimum wages fixed by state govt. in that case why No any legal action being Taken against such stablishment,

sir... question is being arise why No authority initiate to imposed the penalty upon such establishment which are not pay wages to its employee as per the minimum wages act.
even in practically practice have seen many organization not to pay wages as per minimum wages inspite that No action against such organization,

In case of Minimum wages fixed by Govt., the employer is bound to pay the same.
As no authority is seeing the implementation strictly and the authorities are more care about their amount, the Employers are paying less than the minimum wages and managing one side the offcials and on the other side the workforce not to approach the labour authorities for less payment.
Even if any one approaches, they will be stopped from service.
Now a days cost of living is high, any how the employee must have to work for lesser wages also to pull on his livelihood for so many of his personal reasons.
Like that it is going and the act is not helping.

Dear Friends ,
Yes , you are right ,there are certain industries are not paying as per Minimum Wages Act .When Labour Inspector visit the Establishment and put it on record the disparity things go against Factory Manager / Occupier .Till that time rest & wait .
