Default help !! on statutory/ legal matter on ir

hi
m an IR/PM student basically doing masters of labour studies(final)....

being an core IR student i know that; under standing orders employee is not allowed to enter in factory/industrial/orgaisational premises.. n if a person is drunked n enters in its premises it leads to gross misconduct..

now the situation n problem comes in proving if person is drunked or not!! there are many instruments or gadgets like "alchol breath analyser" which can detect such stuff/ drunked breath .. here also can any one tell me if such apparatus is used for the purpose, wether medical certificate of registered or certified medical officer is required or not to take appropriate action against him/her........ has there been any such case law !!

ehnce for the above situation i need help or a way to solution . i ll be greatful for the responses/ suggestions.

Dear Pritam,

You can do the things as you mentioned along with this you have to keep at least two witness for the same before taking any dis. action against him.
