Dear Seniors,
Please guide me as i am facing problem from long time.
We are having 2 months notice period in our company but after getting their salary they left the company without serving their notice period.
Kindly suggest me what all legal activities can we do with them.

Hi Buddy,
If the above mentioned things happens often than you have introspect where you have short comings. I suggest you two ideas which can be used to over come the problem
1. Don't issue the service certificate till finishing the notice period
2. Don't finish the F&F till finishing the notice period
However the above mentioned suggestions becomes void if any person pays for the notice period in lieu of serving it.

Hi Deepali,
I was also facing the same problem in my company. But now we are having a rule that the person who is going to join our company he/she has to submit their original degree certificate/mark sheet. We give it back when they are relieved from our org.

The law allows you to recover the notice pay from the employee who left without notice.
Further, if the unplanned departure has caused any direct loss (Not loss of profit), you can recover that also.
You can send a legal notice and if the person does not pay, you can file a case in the small causes court for recovery of the money.
All this costs money with lawyers fees and other costs. But the cost for the employee is much higher and disruption in his work life is also a critical impact for him.
If you wish to be more vicious, you can find where he is working and send a notice to his current employer.
However, you need to ensure that your own documentation is clear and strong
