We are a company with less than 10 employees, but more than 10 when we include the contract labor(4 Contract Labour).
They are asking us to furnish form V under Contract Labour Law for registration of ESI. Since we have not crossed 20 employees we do not fall under Contract labour Law. Is it mandatory to provide form V to contractors even though we do not fall under Contract labour ?
Is it required to obtain any other labour license like The West Bengal Labour Welfare Board ?
One of our employee has a gross salary of 15,000 but after deduction of P Tax her salary is less than 15,000....is she eligible for ESI ?
It it necessary to get hold of a registration under Contract Labour Act in order to appoint 4 number of Employees under contract?

1. Dear member, you have not intimated in what type of company you are working. Whether it is a shop, commercial establishment, factory etc.?
2. By adding contract labour, if the total number of persons employed are 10 or more, your establishment is definitely covered or coverable under ESI Act, provided it is such type of establishment as defined under said Act. For coverage under ESI Act, the provisions of Contract Labour Act are not relevant. Coverage under ESI Act is independent to any other enactment.

Its an IT Company. By definition the Company falls under the ESI ambit.
Since the number of contracted labour is well within 20, does it falls under the ambit of Contract labour ?
Is it necessary to get a registration under contract labour to contract a labour irrespective of numbers?
