Default Attendance maintained Electronically

Hi,

Can someone tell me if it is legal to maintain attendance of employees in an electronic form. If it is not, is there any particular sanctions that we need to obtain to ensure that we are not violating any law.

My company is a BPO and is registered under the Shops & Establishments Act. The reason for the above querry is because an inspector from the Shops & Establishments Act who visited us said that all employees are supposed to maintain their attendance in Attendance registers and it cannot me maintained electornically.

Need your help.

Hi
Yes as per law it is necessary to maintain the attendance register but it is not necessary to maintain that register manually.

If you are using any software to collect the data of the time cards punched by the employee. You must have the facility of taking the print out of attendance register or muster roll in that software if you don't have the facility then get it modified.

Dear Friend,
The Inspector was right.You should print your attendance output records as per the attendance register & maintain the same by sigining it through Office/Factory manager.This will reduce your liability of Non -compliance.

Thanks for the advice.

Is there a specific format in which the data needs to be maintained? Are we supposed to seek permission from the authorities about maintaining the records electronically?

You should maintain attendance Register in Form-26.
Even Form-26 is called attendance register or muster roll.
