Dear Sir,
Can you give information on Festival Holidays Act?
To whom it will be applicable and what are the compliance to be follow?
I am working in engineering company where less than 100 employees are working. Will it applicable to us?

National holidays and festival holidays is applicable for all factories, shops and establishments. You have to provide compulsory holidays on 26th jan, 1st may, 15th aug and 2nd oct. Five other holidays as per your choice to be provided compulsory every year.

Dear Sir,
We are observing 26th Jan and 15th Aug as a Holiday but rest of two days not.
Additionally, we observing more nine Festival and it is paid by us.
So is there any future consecuences or not.

The Industrial Establishments (National and Festival Holidays) Act is a state legislation and therefore, the number of holidays differ from state to state. In Tamil Nadu it is 4 national holidays, ie, 26 January, May 1st, 15th August and 2nd October, and five festival holidays which the employer in consultation with the workers can decide. The same in Karnataka is five national holidays (in Karnataka November 1st being state formation day is a national holiday) and five festival holidays whereas in Kerala there are four national holidays and nine festival holidays (probably the highest in India with respect to holidays). In UP, there is no mention about Festival Holidays but only national holidays are to be allowed. In Punjab there are four festival holidays and in Hariyana the number of festival holidays is five. In both these states, the number of national holidays is three. Therefore, in order to make sure whether you are following the statute, you have to go through your state’s enactment on National and Festival Holidays. But in any case 2nd of October is a national holiday.

An establishment which has an employment strength of more than 20 is certainly under an obligation to follow the holidays prescribed under the state Industrial Establishments (National and Festival Holidays) Act. Therefore, please take it up and ensure that you follow the rules.

Dear Madhu ji, Good Festival holidays differ state to state but three national holidays are applicable whole over india such as Mahatma Jayanti, Independence day & Republic day.

There is no doubt about it and that is why I have mentioned that Parimal should include October 2nd also in the holidays list. Please see that she/ he has already listed 26th January and 15th August as holidays.

Dear Parimal,
As per the National & festival holidays Act 1958 - we need follow Four National Holidays and Five Festival Holidays (Differ from State to State)
As per the discussion you need to Register and maintain Form III One Time Registration (Update ) & Form VI - Monthly and Form Form V A ( Any Employees are work for same day need to submit the L.O and display the Notice Board majorly need to pay twice Wages or C.Off)
