Dear gentlemen we are having an office at sakinaka we are into i.t. firm and rendering sales & services and reparing of laptops desktops printer and scanner of the customer and giving services to the customers. we had covered and taken shops & establishment act license. a few days before factories inspector visited into our office and he noticed us that your office should covered under factories act and you should have factories act license. he had given us 2 days time. please help and guide us that whether we are in factories act and we sholud have to take a compulsory factories act license. already we are having shops & extablishment act license. waiting for your favourable & valued answer. hsa hr

Dear all i have recently joined a pvt ltd co. in state of u.p. it has work of importing and manufacturing panels & welders exigible under excise act. the company has taken premises on rent. i want to know whether we need to get our rented premises registered under factories act1948 is it mandatory? can we obtain registration under shops & establishment act instead of factories act? also we intend to provide esic benefit to our employees which are around 10 in number and in receipt of wages less than 15000 p.m. is there ay requirement that place must be registered under factories act or shops and establishment act? with regards rb
Which act should applicable for marketing office.
Dear all we have diesel generator assembling unit registered under factories act 1948 where 70 employees are working . we have separate marketing team for the generator sales for them we have separate office which is located other area. can any one clarify me weather it should be covered under shops and establishment or factories and establishment . for factory employees we are following as per the factories act leaves attendance wages etc.. can we follow the same for marketing employees or we should follow shops and establishment rules.
Maternity benefit crèche - factories having more than 30 women workers but less than 50 women workers
Dear seniors please explain the following. i am not able to understand. section 11a of the maternity act safeguards the intent of section 48 of the factories act 1948 which requires factories with more than 30 female workers to have a creche. therefore even if a factory has less than 50 employees but has at least 30 females such factory will be under the obligation to have a creche under the factories act 1948. further if section 11a of the maternity act had been framed to be applicable on establishments with 50 or more female employees then section 48 of the factories act 1948 would have lost its effect as factories having more than 30 women workers but less than 50 women workers would have done away with the compliance of having a creche.
