Hi All,
Retrenchment.
In my organization currently 48 peoples were working under our role now due to low Business we want to retrench 20 employees in the same time can anyone suggest me how can I select the employees for retrenchment.
Any one send me the notice for retrenchment information to an employee.
My Questions are.
1. I want to get permission from Govt official’s i.e. Additional labour commissioner?
2. What was the reason I want to mention in the retrenchment letter?
3. In our organization union is there so can I retrench Union office barriers?
4. How many days salary I want to provide for retrenched employees?
5. It’s mandatory to take back to an employee our organization after the retrenchment?

If the no. Of employees are only 48 on an average during the 12 months preceding the proposed date of retrenchment, no necessity for obtaining prior permission for retrenchment. Retrenchment has to be done only on the basis of juniority - I.e., only juniors in service have to be retrench ed. So no question of pick and choose. For all other details, Pl go thru Secs 25F and 25N of the I D Act,1947

In addition to Mr. Umakanthan, you can retrench on the basis of skill level too. If a newly joined person's skill level is better than the old one, the old one can be retrenched, but you must substantiate with proof.

Hi It is better to go by I D Act and follow the procedure . Check with your Management also. In today’s context how far you will be successful in getting Govt. permission is a big question

Ans- no requirement because your strength is less then 100, but you have to send the information of retrenched employees to ALC
2. What was the reason I want to mention in the retrenchment letter?
Termination of Employment - either one month before of retrenchment or one month notice pay
3. In our organization union is there so can I retrench Union office barriers?

4. How many days salary I want to provide for retrenched employees?
Ans-15 daysretrenchment componasation for every year , leass then six month will be ignore and more then six month will be treated full year.
Suppose he worked for 3 years and 6 months you will have to pay 15 days pay * 4 = 2 months average pay. if he works 3 year 5 months you will have to pay 15 days pay * 3 = 1.5 months average pay.
5. It’s mandatory to take back to an employee our organization after the retrenchment
