Hi i had completed 4yrs 11 months in my comapny. now i want to resign . as per our co. rules we have to give 1 month notice. i want to know that if i resigns today will i get a gratuity? or i will have to complete 5 yrs & then i will get the gratuity? let me know the rules regarding gratuity so that accordingly i can resign.
Clarification regarding ctc
Dear mallik sir i would like to have a small clarification in regard of ctc in ctc since begining we have taken gratuity as a part of ctc and on the same we are issuing apppointment letters also. now my query is wether any employee can challenge us to pay gratuity with out completion of service period. as it is shown in the ctc in the appointment letter it is mention as gratuity and nothing is mentioned against that. kindly reply for me thanking you sir with regards nvrao hyderabad

Dear seniors i need clarification on gratuity for this case employee has joined the company on 1st of october 2008 and he resigned & company relieved him from the duties on 31 august 2013. the employees worked in the organisation 4 years 11 months continued service. company head office located at mumbai. but they established their factory in tamilnadu. factory is registered under the factories act in tamilnadu. questions: 1. either the employees eligible for gratuity or not??? 2. company has to follow the tamilnadu gratuity rules or not? 3. as per the gratuity act we have to consider as continued service if employee worked 240 day in the respective year. so that why cant we consider as continued service in the fifth year if employee worked 240 days??? now the company says as per the central gratuity rules employee not completed years of service so that he cant deemed gratuity as per the rules. note: judgment has given by the madras high court: mettur beardsell ltd vs regional labour commissioner madras high court.1998 as you aware. kindly provide recent judgment on this by any courts. regards mashr

Hi i wanted to know if a person who has served in a private organisation in india for 4 1/2 years whether he is eligible for gratuity or not . is notice period considered as a term of service. also whether the payment of gratuity act overides the companys own set of gratuity rules ? are there different set of rules for indian and foreign companies operating in india ? thanx.
