Dear Seniors,
Help Needed.
In my company we have received letter from a union stating that they are having majority and thus this are the people we are protected work and also demand of chatter
What should I do know what should be management stand also please any other information I need to know to reject this

hai,
Talk with the Union team and make a meeting with Management, let you know their views and problems. pls don't think these Unions are opposite with Mgt. It is one way to know the organisation culture and situation.
Hope it will give positive results.

Hi Shakila,
In my company we have received letter from a union stating that they are Hey, don't panic :D ..it is natural process for a group of people especially workers who come togather to form a Union.
Frankly, this demand may have come on results or actions displayed by your company in the past. Just do reality check.
What is more is important as elaborated by Pawan - have a meeting and take stock of the situation.
BTW having a union helps - it helps to control costs esp wages as you deal with a union on compensation as a whole rather than the group of people on a individual basis.
Let us know the facts before we advise further.

Hi,

1. asecrtain whether the union has been registered.

2. no trade union of workmen shall be registerd unless atleast 10% or 100 of the workmen whichever is less enaged or employed in the esyablishment or industry. And for registration purpose minimum7 workmen is required.

3. the burden of proof lies on the union to prove that they have the majority of the employees in their union.

4. they should accept and adhere to the code of conduct.

5. if your satisfy the statement of the union on majority the you can very well recogonise so that you have the negotiations with them. becuase you cannot sign an agreement with the minority union.

6. if you have more than one union the unions should prove the majority and never ever have any discussion with the minority union ( if you have more than one). if you do so the majority union will raise a dispute and make your negotiation null and void. And you will be held between the two union.

7. Ofcourse the protected workmen is contemplated in section 33. It says Protected workmen in relation to any establishment means a workman who being a member of the executive or other office bearer of a regd. union connected with the establishment is recogonised....... the number of workmen to be recognised as protected workmen for the purposes of sub section (3) of sec33 shall one% of the tyotal number of workmen employed therein subject to a minimum of 5 protected workmen and maximum of 100 protected workmen.

8. You cannot reject the letter issued by the union since their approach is as per statute. If you do so it will be in violation of under FIFTH SCEHDULE of ID act.

9. Pease do remember that Union is a necessary evil.
