Before terminating you should provide all possible things to improve the performance of probationer still he/she does not improve then you should communicate the same to him/her in oral as well as in written.

Reference to Mr Prashant's views, a look at the decision of Pujab and Haryana HC in President, ....Vidyapeeth v Presing Officer decided in 2013 can be given.However, as per Delhi Shops and Establishment Act, if probationer who is employee has completed more than three months continuous service, he shall be given one month's notice.

Communicate on record in writing under proper acknowledgment and support to bring improvements..... before issuing termination order.

Dear Irin,
In your appointment letter , it should be mentioned clearly that there is no either or notice from employee and employer . Its for both the parties to serve notice or not. And i am totally agreed with Mr. Prashant's opinion

Defination of probation period is that a person is employed temporarily against a clear cut permanent position in the organisation after undergoing the hiring procedure. Usually the period is Six months where the employee has to render the services to the satisfaction of the employer. Now this clause to the satisfaction of the employer is very difficult to interpret as what will satisfy the employer and mostly the employee and not promoted to permanent position if the company does not want him by giving a week notice or a month as the case may be even without giving any valid reason for the same.
