Dear Seniors,
kindly note that i have served a months notice before my resignation was accepted (actually 20 days and 10 days were adjusted from the PL) by my ex-employers. Before my resignation was accepted handover takeover was done formally on paper and also on software. Now after joining the new company the previous boss of mine started complaining that , i colluded with the clients in my previous company and was a partner in some unlawful activity and so my full and final settlement shall be on hold. Well, please also note that it has been already 75 days has been passed since my resignation but no formal mail or letter has been sent stating the reason of keeping my settlement on hold. whatever request mails i have sent , all gone unanswered. some of my bosses also telephonically threatened me that they will ruin my career.
how can someone held me responsible for me for a location or a case , when the handover and takeover was done very well. Even the resignation mail was accepted and the date was also mentioned as my last working day.

What to do, please help. I am under huge stress and mentally disturbed.

If you were governed by shops and establishment Act or by ID Act, then after expiry of 30 days period or 20 days and after adjustment of 10 days EL you were deemed to be relieved. Send a representation to the concerned inspector to get you relieving order. If you are not still able to obtain pl come up again.

Dear Sir,
thanks for an early reply. Its a collateral management company and i have no idea about that "shops and establishment Act or by ID Act" . Is it possible that my ex-employers may send a notice to me , as they are presently threatning. Though 75 days have been passed.

It is apparent that you were covered under Shops and establishment Act. You need not worry. Pursue the remedy as suggested.

Dear Sir,
thansk for the reply,
today my ex super boss called me up and said if i donot go to my old place of work and dont help them resolve the issue then they will send a notice to my present company stating some complaint.
What to do???

You can tell him that you would sue him for damages for defamation and prosecute him for criminal defamation apart from prosecuting him under shops and establishment Act. Send a legal notice through lawyer.

sir, it is a corporate company... does it come under shop and establishment act??? could u please eloborate if an employee can be held responsible for something after successful handover takeover process???

As I said earlier, apparently that company is covered under Shops and Establishment Act. After your resignation was accepted by your employer, he cannot now issue you any threat unless you had committed any penal activity eg misappropriation. Acceptance of resignation is a conscious act. Under the said Act, he could have recovered damages for loss caused to him in the manner provided. But now it is too late. You pursue remedy as suggested.

Dear Sir,
i think i need to eloborate the matter a little more.
There has been a incident of fraudulent activity in one of our locations, i came to know about the same after 2 months of starting the location. I let the management know about the same and then it was instructed to me that , there is no need to communicate in written or formal way , as they would handle.
After i received some better offer, i put down my paper after 20 days and also serve a notice period of 20days +10 days PL adjustment. On 31st Oct'14 my resignation was accepted over mail while keeping the HR in loop. After sucessfully resigning and handover takeover is done, i joined a different company. Now the earlier company has put my entire dues on hold stating that i knew everything and i didnot report on time.
As it seems that the bosses of my mine never let the upper management now about the entire incident when i reported back and now they are trying to trap me in to it.
they are threatning that hey would send me a notice or they will send a letter to my present employer.
Kindly note that my earlier role was of BDM(business development manager), i had nothing do with the operations as such, but on verbal request frm the superior i visted that location sometime but nothing wrong happened at the time i have visited. Also there were independent audits happened by our auditors while the location was on , nothing wrong was ever reported about the same.

The earlier bosses seem to harass you. Pl pursue the remedies suggested earlier. Your should be able to send appropriate legal notice to them and if necessary file a criminal complaint against previous bosses after getting detailed facts from you. If you are a female then more strenuous action can be thought of against them.
