Dear seniors one of my staff member is on maternity leave from dec 2016 tough she does not cover under she has been given maternity leave for 3 months. now as the new bill has passed from parliament that the maternity leave is extended for 24 weeks from 12 weeks can we extend her leaves as she has applied for extension also she will be on loss of pay but we need to give her benefit of the act. any information regarding the new bill pass links only with the esic but what if a woman is not covered under esic and is eligible for maternity benefit under act. kindly give your valuable suggestion & feedback.

Dear all as per which act should i comply with to calculate maternity benefit.? i am confused a lot between these two variations. which one should i follow.? "maternity benefit act 1961" section 5. right to payment of maternity benefit. subsection 3 the maximum period for which any woman shall be entitled to maternity benefit shall be 26 weeks of which not more than 8 weeks shall precede the date of her expected delivery: "andhra pradesh shops and establishment act" section 25. maternity benefit. every woman who has been for a period of not less than six months preceding the date of her delivery in continuous employment of the same employer whether in the same or different shops or commercial establishments shall be entitled to receive from her employer for the period of a six weeks immediately preceding the day of delivery; and b six weeks following the day of delivery; such maternity benefit and in such manner as may be prescribed: provided that no woman employee shall be entitled to receive such benefit for any day during any of the aforesaid periods on which she attends work and receive wages thereof.

Esic notification issued for the increase in maternity benefit from 12 weeks to 26 weeks effective from 20th january 2017 by virtue of amendment in the esi rules an insured woman shall be entitled to 26 weeks maternity leave. an insured woman having two or more than two surviving children shall be entitled to receive maternity benefits during a period of twelve weeks of which not more than 6 weeks shall precede the expected date of confinement. clause 6a of rule 2 of the esi central rules following clause has been added. 6a insured woman means a woman who is or was an employee in respect of whom contribution is or were payable under the act and who is by reason thereof entitled to any of the benefits provided under the act and shall include: i a commissioning mother who as biological mother wishes to have a child and prefers to get embryo implanted in any other women; ii a woman who legally adopts a child of upto three months of age.;

If a lady employee comes under esic act and she is getting benefit through esic for her maternity does she still get the benefit from the company as per maternity act for 3 months paid leave.

Dear fellow members i have one query related to the maternity benefit under one of our female employees is covered under she is pregnant now. but in her two years of employment with us she has not taken any esic benefit or even taken tic. she went on leave by just giving simple leave application of prolong leave. meanwhile we have arranged tic to provide her maternity benefit. which tic not reached to her. as per my knowledge she need to visit esic office once before edd to get the benefit. but before that we came to know that there was a miscarriage. kindly advise that if she is still eligible for the said benefit under esic ? thanking you in advance. maulik dave
