Dear Seniors,
We are one fabrication contractors registered under ESIC Act and working for companies situated in implemented and non implemented areas. We are paying contribution only for employees who are working in the implemented area. Now we are having one problem. ESIC asking us to pay contribution for employees who are working in the non implemented areas also. Please let us know is it correct.

Sir,
1.I think you would have contested the payment of contribution in respect of employees working in non-implemented area before appropriate authority of ESIC. There must be some other facts or reasons on the basis of which they (ESIC) have demanded contribution in respect of employees working in non-implemented area.
2. If your facts are clear as mentioned by you, you can represent your case to higher authorities or even take up the matter before appropriate hon'ble E.I.Court.

Thanks for your mesage.
I wish to know only one thing. Whether i have to pay contribution for the employees who are working in non-implemented area or not. If not, which section is exempting the payment of contribution. During one inspection one officer also told that no need to pay contribution for non-implemented area.
I also wish to bring to your kind information, that there is reason available in the monthly contribution template vide code No.: 6. for zero contribution, as "non implemented area",
If i have to pay contribution, then what is the purpose for code No.: 6.
Pl. help me by providing the detail.

If your workers are working in the non implemented area for not less than seven months in a year, you can exempt them from coverage provided the State Government has given such exemption by notification following section 88 of the ESI Act. In Kerala a similar notification exempting employees working in non implemented area and touring employees who remain out of implemented area for seven months and more is available. Please go through the attachment.
