Dear Friends,
I joined a factory into fabrication activity. Shortly after taking over the responsibilities, I realised that the PF and ESI are not remitted for a period (that I'm still investigating). Meanwhile I wanted to ensure that the PF and ESI atleast for this financial year is remitted. I would like to acknowledge my ignorance of the procedure on how to go about with the outstanding remittance and will be grateful to be enlightened on the process, besides few queries I raised here, in particular.
1. How am I going to remit the PF and ESI for the period starting April 2014 till now
2.How about the employees who have already left the organisation. Is it fine to ignore them or should we be remitting even for them
3. How do I go about with opening new accounts, if I may find employees who have not joined after April 2014 and do not have PF and ESI account.

Sir,

So far as compliance under ESI Act and rules/regulations framed thereunder is concerned, I hope you will take following actions immediately:-

1. Firstly, ascertain for which period compliance has not so far been made.

2 Secondly, ascertain the names of employees, who do not possess insurance numbers and identity cards. Submit declarations forms in respect of such employees. This procedure, as you may be aware, is also available online.

3. After getting insurance number in respect of all employees, calculate the dues every month to be paid since the period of default and deposit all such dues immediately.

4. After making upto date payment of contribution or contribution period ending-wise submit returns of contributions to the appropriate office(s) of ESIC. Such facilities is available online and perhaps at present monthly returns are generated online. Please contact your concerned branch office for guidance in the matter, if any, required.

5. Also try to get permanent Identity Cards/Family Cards in respect of all employees.coverable.

6. Please also ensure that all type of informations or returns viz. accident reports etc., if occured, may be submitted to the office of ESIC in time.

Sir,
1. Yes. Compliance is required to be made in respect of all employees eligible for coverage under respective Acts irrespective of the facts whether they have left the job or are still in employment.
2. If you will not make compliance at this time, later on in the event of inspection of records, the same can be pointed out as omitted wages and your establishment will be required to pay/deposit the dues alongwith interest and damages as may be payable as per rules/regulations.
