If the probation of an employee is for one year and if he is not confirmed or probation is not extended after completion of one year, after what period (how many months) he gets automatically confirmed by the regulations? Please clarify.

Dear Professional,
If you do not receive any written letter from HR regarding your confirmation, as per my knowledge after completion of probation period your are automaticaly deemed as a confirmed employee of the company.

I have received the confirmation letter from the Head ofthe institution. However, now due to an ego clash, he claims that he is not supposed to give the confirmation and it has to given by the governing body. I am working in an autonomous institution registered under societies act funded by the government. Memorandum of Association of the organisation says that officers are appointed by the governing body. But it does not say that such appointments are to be confirmed by the governing body. Also, till date, all confirmations are done by the Head of the Organisation only. In my case also he issued confirmation letter but now states that it needs to be ratified by the governing body.He can influence the governing body and get it cancelled. But, such an act is legally tenable?

Hi Friends,
Here I have a different opinion given by Mr. Dharmesh. A probationary period is effectively a separate ‘fixed term' employment contract that precedes your permanent employment relationship.
However the employee doesn't receive any letter pertaining to the conversion / confirmation of his employment. Hence It seems to be legally invalid or inappropriate to assume that the employee is confirmed in terms of employment contract and even further it couldn't be accepted by any government / private entities across the country...

Please check if there is any wording in the probation order that states confirmation requires an order in writing and also states that the absence of any letter of extension of probation it should not be deemed to be confirmed. If these are there, you can not deem to be confirmed.

No such clause in the appointment letter. It just says that I will be on probation for one year from the date of joining.

Unless and until it is conveyed explicitly in writing by the appropriate appointing authority confirmation can not be assumed. Better to discuss with the concerned and decide accordingly.

Dear Sir/Madam,
I was working in School in back office/Admin depart. I joined there 1-1/2 months ago. at the time of joining they gave me a 2 years contract form, with 1 year probation. 2 days ago they called me & said we are not satisfied with your work so we discontinue with you. I asked why? they said you are very slow and very quite kind of person, we didn\'t like your nature of work. so we leave here. but I am not satisfied with this reason.... what should i do???
