Termination during notice period
Hi seniors requesting your guidance on this particular case. an employee was advised to proceed on transfer for which he expressed his inability siting domestic issues his mother expired recently. he was asked to put his papers verbally if not proceeding on transfer. accordingly he submitted resignation letter in which he promised to continue during the notice period which is 3 months or compensation in lieuas per terms. after 2 days his mail was blocked and his permit withdrawn making the office premises inaccessible to him. does this amount to termination? he demanded compensation in lieu of notice period which the company denies. is he eligible to get the compensation? please guide.
Compensation to be paid on termination???
Can u plss suggest on the following: the mangement of our company has decided to terminate a few employees by paying them 1months salary in lieu of 1months notice for termination. however the mangement has decided to pay only the 1 month basic salary as compensation instead of their last drawn salary inclusive of all allowances. beneifts etc.... wanted to know whether this is a right course adopted by the mangement... is there any act which states that the compensation to be payable in lieu of 1 months notice on termination should be equivalent to the last drawn salary and not only the basic salary??? thanking you regards amita

Hey i gave my resignation on 11 aug . i have a notice period of 1 month written in my appointment letter and am probationer not a confirmed employee. could you please tell me if notice period is must for me and can i pay lieu of notice for a number of days? for example: i have worked for 20 days of my notice period and i pay lieu of notice for 10 days. is this possible? regards ankush

Hi members need some clarification for calculating the salary in lieu of notice period. my appointment letter states that i need to serve 2 months notice period however either party can end the employment by paying 2 months salary in lieu of the notice period. my salary structure has the following heading . 1 . basic 2 . hrs 3 . conveyance allowance 4 . mobile allowance 5 . special allowance 6 . bonus how will the salary in lieu of notice period calculated. what headings of my salary will be considered while calculating this.

Dear sir/madam i was working as manager in an mnc in chennai. as per my offer letter notice period stipulation is as follows. you shall give the organisation atleast two month s notice of your intention to resign. the organisation reserves the right to accept your resignation with immediate effect at any time during the notice period. the organisation shall be entitled to terminate your employment at any time on giving one month s notice or without any notice on payment of one month s salary in lieu of notice. despite this the ceo terminated my services without any giving me 1 month notice or 1 month salary in lieu of notice. in such situation am i eligible for 1 month salary in lieu of notice. kindly guide me what measures are available to me. best regards vinay

Hello i m working with a mnc. the offer letter says that company can give me 2 months notice in writing or pay 2 months basic in lieu of notice. i can also give 2 months notice in writing or pay 2 months basic in lieu of notice. but i m not getting change to exercise this option after my resignation. i have done all the handover also. the hr mgr verbally says even though it is not written it is only after interest of employer is served i.e. the technical manager clears everything. is it right? does the labour law work like that? hoping for your help. guru
