Dear All,
I work with a UK based travel firm in Gurgaon and have women employees working for evening and late night shifts.
As per the Punjab Shops and Commercial Establishment act which is applicable for Haryana as well, we are supposed to
provide women employees office transportation post 8PM. There are few women employees who don't avail the company's
transportation and commute on their own (personal vehicle or picked up by spouse) during odd hours, we want to stop this
practice immediately as there is high safety risk. Please guide how to stop this ?

First of all would like to clear the section 30 of Punjab Shop & Establishment Act as applicable to Haryana state prohibit employment of women during night shift.
And if you are employing women in night shift than need to have an exemption order under section 28 from the exemption from the operation of section 30. The labour commissioner have power to exempt.
Employer need to file application in performa provided by labour department along with contractor of transport, security arrangment and detail of drivers and security guard. Post exemption order you can employee women employees in your establishment during night shifts.
If the employee is picked up by their own relative per se spouse/husband, than i don't think there is any problem to same.
But still for security measure, you can formulat policy for security and transport for night shift employees and make that mandatory of all employees and constantly monitor the same, with cautions.

Hi Meenakshi,
As per the the rule the company is supposed to provide transportation to women employees post 8 pm. However in case some women employees wish not to avail the facility, u can take it in writing.
Please issue a circular and ask everyone to sign the same. You cannot force the employees to take transportation.

Exactly, Please issue a circular saying that the responsibility of the Company will be taken only in the case of Company provided Transportation is availed by the Women Employee. BS
