I have worked for 4 years 210 days in my company. my company operates for 5 days a week. now the question are two 1. is there a provision in gratuity act which entitle me for the gratuity as i read somewhere that people with more than 190 days in service are eligible if they are working under ground or company working days are less than 6 days 2. does company has any discretion in deciding the gratuity eligibility in case the employee has served less than 5 years? request you to please suppport the answer through references to cases or act.

Dear sir i have 2 queries regarding the gratuity act. 1. as per payment of gratuity act 1972 employee become eligible for the gratuity when he has completed continues five years service. my doubt is whether he has to complete 240 working days in each year or it is only for 5th to continue 240 working days for eligibility. 2. is paid leave / sunday in case of 6 days of week / saturday / sunday in case of 5 days of week / national holiday would also be counted in working day for calculation of 240 working days. thanks & regards

Hi i joined the mnc in july 2007 and last working day would be april 30th 2012. am i eligible for as i have completed 4 yrs and 9 months 240 days ...please let me know whether saturdays & sundays are not considered while calculating the working days 5days a week. is gratuity amendment is applicable for haryana state too..? and how we calculate gratuity....

Dear sir i have a query related to gratuity. i am working for it sector in chennai and got resigned. previously my company follows 4 years 190 working days rule and now it follows 4 years 240 calendar days rule to claim gratuity amount. my date of joining:15mar2013 my last date in company:15dec2017 i have worked for 4 years 9 month please let me know whether am i eligible for claiming gratuity amount according to 4 years 240 days rule and 4 years 190 working days rule?. awaiting for your kind reply
