Hello, Pls see my query and looking for an early reply. I am a manager in an IT Consulting firm in Delhi and they have a policy of work from home for the benefit of their employees during their illness. As I was quite ill so they gave me the option to work from home.

The policy says that the complete salary will be payable to me but with a rider that this will only be paid to me after 5 years in the future from the last day of WFH been done by me. But being ill and difficult to take stress I have agreed to this policy. Pls, advise me that any company can have this kind of benefit with such a rider.

They have given the salary on time for the months in which I was working in their office.. Can an employer pay the arrears of salary of an employee after 5 years on the basis of their policy of Work from Home? Pls, advise and clarify as per Indian law?

Dear Mini,
As you said that, you are working as Manager, so, none of any labour law is applicable to you.
2nd, said term is agreed by you post mutual understanding from both parties, so, it is very dificult to challenge the same in Civil court too.
You should have think before sign such agreement.

Thanks Tushar.....
But if you can give any reference regarding some HR advisor in delhi then it will be great.....
One more thing to ask that if now I would be employed with some other employer then they will consider these arrears of salary as my salary of that period or not.
Because at that time there was no tax deduction hence no form 16 issued to me as my salary of regular days was quite lesser from taxable slab. And rest of salary was of Work from home option to be given after 5 years.
Pls advise and suggest.
Thanks.
