Hello, I want to know what percent of wages is payable to insured workers during the periods of certified sickness under ESIC Scheme.. The ESIC website mentions 70% Employee's State Insurance Corporation whereas the FAQ of the same website mentions 60%.. Please help

Sir,

1. Sometimes, the old printed materials are not updated on the websites of the Government Departments. You can, however, point out the errors, if any, to the head of Region/Sub Region of ESIC on which website old rates are exhibited in any printed material.

2. Wages are not paid under provisions of ESI Act, 1948. The claims under said Act are called as "benefits".

3. The present Benefit rates are as follows:-

Sickness Benefit @ 70 % of the standard benefit rate of insured person during the corresponding contribution period (Rule 55).( Extended Sickness Benefit for 34 specified long term diseases is 80%).

Maternity Benefit @ equal to the standard benefit rate of insured person during the corresponding contribution period (Rule 56).

Disablement Benefit @ 90 % of the standard benefit rate of insured person during the corresponding contribution period (Rule 58).

"Standard Benefit Rate" has been defined under Rule 7-A of the ESI (Central) Rules, 1952 as " means average daily wages obtained by dividing the total wages during the contribution period by the number of days for which these wages were paid".

I hope you will consult and refer to the updated ESI Act, 1948 and rules / regulations as amended upto date.

55. Sickness benefit. [/B]— (1) Subject to the provisions of the Act and the regulations, a person shall be qualified to claim sickness benefit for sickness occurring during any benefit period if the con¬tributions in respect of him were payable for not less than seventy-¬eight days in] the corresponding contribution period and shall be entitled to receive such benefit at the daily standard benefit rate for the period of his sickness :

Provided that in case of a person who becomes an employee within the meaning of the Act for the first time and for whom a shorter contribution period of less than 156 days is available, he shall be quali-fied to claim sickness benefit if the contribution in respect of him were payable for not less than half the number of days available for working in such contribution period :

Provided that he shall not be entitled to the benefits for the first two days of sickness [except] in the case of a spell of sickness follow¬ing, at an interval of not more than fifteen days, the spell of sickness for which sickness benefits were last paid :

Provided further that sickness benefits shall not be paid to any person for more than ninety-one days in any two consecutive benefit periods.

(2) The daily rate of sickness benefit in respect of a person during any benefit period shall be seventy per cent. of the standard benefit rate of that person during the corresponding contribution period rounded to the next higher rupee
