In India only 3 national holidays (Jan 26th, Aug 15th & Oct 2nd). May day is not a national holiday. Educational institutions function on May day. Only Industrial establishments are closed.

I still stick to my old view. National holidays covers not only industrial establishment, but also covers, all factories and also plantations.
For your ready reference I am copying section-3 of the National & Festival Holidays Act.
QUOTE
3. Grant of National and Festival Holidays.- Every employee shall be allowed in each calendar year a holiday of one whole day on the 26 th January, the 15 th August the 1 st may and 2 nd October and nine other holidays each of one whole day for such festivals as the Inspector may, in consultation with the employer and the employees specify in respect of any industrial establishment.
UNQUOTE
It can, thus, be easily inferred that 26th Jan, 15th Aug, 1st May, and 2nd Oct are national holidays.
If other members have different views, such views are welcome.

1st May is a declared holiday (along with 3 mandatory ones) in Maharashtra as it is Maharashtra Day.

National holiday is different than festival holidays. I am of the firm view that May Day is not a national holiday. During national holidays, all establishments remain closed other than essential services. If some urgent works are to be carried out during national holidays, permission has to be obtained from the Labour dept. Whereas this condition is not applicable for Festival holidays.

I too agree with you that National holidays are different from Festival holidays. Festival holidays differs from State to State
But the four National holidays remain constant throughout the country.

Friends,

Let us strictly confine the discussion to the situation in respect of industrial establishments in the country. Grant of National and Festival holidays are governed by the respective State Acts for this purpose. For instance, the Tamil Nadu Industrial Establishments (National &Festival Holidays) Act, 1958 allows 4 National Holidays(26th Jan, 1st May, 15th Aug and 2nd Oct), whereas under the Karnataka Industrial Establishments (National &Festival Holidays) Act, 1963, there are only 3 National Holidays (26th Jan, 15th Aug and 2nd Oct). Similar differences are apparent in other corresponding State laws, not only in respect of 'national holidays' but also festival holidays which are based on local customs.

Hence, to me the term 'National Holiday' itself appears to a misnomer, because unless it is so provided under the concerned State Act, it does not necessarily mean that all industrial establishments in the country have to observe a holiday, as in the case of May Day,

The 1st of May is observed as a holiday for industrial establishments employing labour throughout the country but it does not cover other establishments. So the fact that it is observed as a holiday nationwide cannot be construed to designate it as a national holiday. The two differ in essence. In that one set has an element of national pride attached to it and the other is simply a functional holiday facilitating workers to honour the tools of their trade!

National & Festival Holidays Act declares MAY DAY as holiday with wages.
However, some companies will work on that day by allowing the employees
to hoist May day flag before the Factory. After performing May celebration for one or two hours, the company will provide snacks/ tiffin, tea then they will resume to their duties as usual if the employees are required to work.
Working on May Day ( holiday) , they will get extra wage twice for that day's work in addition to their normal wage for that day,
This will be in practice in the case of work exigencies, otherwise in normal course, the co. will declare paid holiday.
