I am agree with you regarding what situation right now Avtar's is facing.. as we memebers are advised him both the side in lagal as well as moral point of view. now his decision which need to be take..? but end of the situation only the legal steps need takes..
But, here i would like to bring to you all notice that, if no one can anwer him stronglly by law, & if now bending knees in front of him, shall be the cause of feeding to his confident / unethical behavour at higher level & in future, he will not hessitat to do such things with anyone..

I would second Mr. Taj Sateesh, one should bear in mind the practicality whether the employee can afford the Legal way i.e. time and money. The company can terminate the employee by many means, which I don't think has to be told in the forum. So it is advisable to submit the resignation stating the salary and other dues pending has to be settled within a stipulated period.

Hello,
What ever has happened is completely unprofessional from company's side.
First of all please start looking for a new job. It will take time but i'm sure u will get one within 2 months.
Do not get disheartened.
If u ask them to terminate you it will be a scar on ur future. Resign...atleast u will get ur dues.

BECAUSE SOME TIME COMPANY DEDUCT ONE MONTH SALARY IN F & F SATTELMENT.IF I NOT MENTION NOTICE PERIOD IN MY RESIGN.

Hello Avtar,
Just mention that you are willing to serve the Notice Period as per Company Norms.
But better checkout how much is it--so that you are not taken for a ride again later.
This is also usually mentioned in your Offer/Appointment Letter.

As said by Mr. Tajsateesh please mention your willingness to service the notice period starting date and end date, if the company relieves you on the very first day of your resignation letter then legally they cannot deduct the notice pay. They have to pay for all the days you worked.
