I am Prithvi working as a Interior Designer for an Architect in Bangalore. I have been working for 4months. 2months after I joined the firm I was given a agreement to sign, the highlighting point was:-
# 6 months probation period, if given resignation should serve 30days notice period or pay 45 days salary to the Firm. After probation period 90 days notice period or pay 45 days salary to the Firm.
After completion of my 4months in the firm I gave my resignation for my personal reasons. The Architect accepted my resignation and asked me to serve 30days notice period or pay 45days salary to the firm. I accepted to serve 30days notice period but asked to give my Original Appointment letter With Relieving Letter and pay my salary for the notice period term.
My request was denied and the Firm insisted me to pay 45days of my salary to them.
Hence I did not go to work from then. Can they take any Legal action on me for not paying them or what else can they do Please guide me through.

Hi Prithvi,
This practices is adopted and applied by highly irrational and traditional companies having no concern for employees. They will not able to take action against you. Remember don't handover original papers to any employer to whom you are working they will try to dissolve your matter.

Generally an appointment letter has a clause on Notice period which contains two alternatives either to serve the notice period or pay in lieu of that. Since you have agreed to serve them your employer should have allowed you. Do you have any thing in writing from them?You were also to obtain no due certificate from them.
Now that you have left the office without duly getting relieving order, they may write to your present company to collect the dues or take necessary action.
You need to brief everything to your present employer .If they support you there is no risk.

Im a employee of a Corporate Company
for me 3 months is notice period,i got a better opportunity and they told me join within one month,so i requested my HR to relieve me in one month(as stated in my offer letter,so i have to pay 2 months salary,even i said yes to them) they not accepting,so i served one month notice period and clearly stated the mail and will not be reporting office from this date,filled my exit details,submitted my id card and all formalities,whether this will be treated as ABSCONDING,
will i get my Relieving letter,PF etc..
