HI All,

I am a HR. I worked in a company last 6month. It is a new register company. New venture. They did'nt give any salary last 3 months. When I asked they told they will clear all money. But suddenly I need money as i has to pay my room rent. When I asked they was shouting on me and it was very rudely. So I gave the resignation on that day(21-03-2014). I gave resignation through mail but they was denying to accept that mail. They are not reply anything. Whenever I asked about my money they are telling we are not accepting your Resignation letter.

What they mentioned as their mail. its below mentioned:-

"Please note that as per below email it’s not possible for us to accept your resignation letter because as per the company rules; A Human Resource manager should complete the notice period.



When it comes to Employees; if there is no work or project we can relieve them on the same day. But when it goes to Human Resource Manager, He or she must complete notice period, as because we don’t have other HR Manager.



Please Note: Till we hire the other HR Manager; we are requesting you to present in office. If you are not ready to complete the notice period we consider it as Termination. And also you are not authorized to send any email, Message or Call to Managing Director.



Requesting you to present in office and continue the work."

But there is no appointment letter. They took back my appointment letter. In appointment letter my Salary was 21K. I have only scan copy and x-rox copy with me. I want to stop all this fraud thing. I want to take them as legal notice. How can I handle this situation. They are trying to gran my salary. They dont want to give remaining balance.

Please suggest me what should I do. Please asap let me know.

Dear Sangeeta

Please keep all the records.

1. Now you have the xerox copy / scanned copy of Appointment letter in which your salary is mentioned as Rs. 21000/- Eventhough you do not have any original appointment letter in your hand, you have the xerox copy of the appointment letter. So your first point is cleared. You can argue with the photocopy of the Original.

2. Please keep the Salary slip issued by the company on your name and create the second proof of employment with the company.

3. Store the soft copy (duly scanned) Identity card of your company issued to you in your personal email. (You can save the salary slip and appointment letter also in personal email)

4. Further take the print out of your resignation letter submitted by you and keep the record.

5. Keep the print out of their reply, so that your employer-employee relationship is confirmed with that reply given by you.

6. Now you can file a complaint with the licencing officer / registering authority (hope yours is registered under S&E Act) regarding the non payment of your salary since last three months. (Please give further clarification in this aspect - Please confirm the non payment of salary is only for you or for all the staff working in your company?)

7. What is the clause in the appointment letter regarding separation. Please give some more details regarding notice period and separation clause.

8. You mentioned in your query about fraud. What is it. How you are planning to stop the fraud taking place in your company. Have you made any sketch for that. Give some more details regarding the fraud taking place in your organisation.

9. What is the size of your organisation. Do you have any Trade Union in your organisation.

10. How is your relationship with other employees in your organisation.

11. How is your financial background. Can you withstand for some period without any employment, till you get justice.

12. If you go for legal remedy, then other employers also will hesitate to engage you and they will mark you as problem creator. Then your future employment will become questionable.

13. How do you feel about quitting the job and explain the present scenario to the new employer and grab a good job in some other company.

Think 100 times before making any move.

Sir,
This all answer will go in water. Because employer can handle all the expenses but employee cant do anything and also again they have to think about their future. Means in every situation employee is in a big dirty hole.
Its not a solution sir. Seriously we have to think before joining in a company.

Always if we are frank enough to disclose truth about our previous employment, there will not be any problem in future employment.
Please try for some other opportunities and get yourself shifted to new post. Then inform the old case and you can try to get the salary from your previous employer with the consent of new employer.
If you do so, then there will not be any problem with new employer.

HI Sir,
Kindly check the below mentioned list:-
1. This company has registered with S&E Regulatory Act.
2. They registered with 19 employee including Director and managing director, but Total employee strength is more than that.
3. They are not issuing any document to their any employee.
4. They are not paying salary on proper time to their employees.
5. They are not deducting the professional Tax. As they are not registered with PT.
So how can I handle this. Plaese i want to tell them don't make employee fool and start playing with their future.

Dear Anonymous or Sangeetha as named by Mr. Bhaskar,
Good evening,
Sorry to see your condition, But things should not
be taken easy, at the same time we are worried why pupil like you are not ready to get assistance from the department of Human Resource Development (Govt Of India).
Any ways if you wanted your issue to be settled ,we will be in need of the following documents to take action against the management ,
1. Your appointment order , even if xerox no problem.
2. Your employment period with your employer ( ID card, all Corresponding mails from your HR and your company)
3. pay slips proving your salary with the organisation.
4. the resignation letter that you forwarded to the company.
5. the mail that you received back from your organisation regarding your resignation.
6. final statement of your management about the issue that you are facing.
If you can mail me all these details , can help you out with a better solution.
