In case after registering the establishment at any point in time, the number of employees working in it becomes less than 20 then will the Act apply ? if yes, can you specify in which Act / Rules and clause No.?

Dear Tutu_sr,
The Section 1 clause no. 5 of "The Employees provident fund and miscellaneous act, 1952 " clearly states that : "An establishment to which this Act applies shall continue to be governed by this Act notwithstanding that the no of persons employed therein at any time falls below twenty"

Since your service is more than 10 yrs your form 10 C will be rejected every time because you are not entitled for withdrawal benefit of pension fund.You submit 10 D for scheme certificate.

Dear Varghese ji, If I am not mistaken, for scheme certificate same form 10C is to be filled in. Probably the queriest is not choosing the option of scheme certificate in the said form.

Dear seniors we had 5 branches different place in Tamil nadu. Every branches had 6 employees. Till date we have no coverage the esi and epf .but the head office working in only 2 member.
If we will not contribution the pf and esi any problem arise the future or
What is the act to consider the provision
How to we will coverage the headoffice and then we will get the sub code for another branches.

Dear Muthuselvammsw,
As you have mentioned that you have 5 branches with 6 employee in each branch. That means, you have total of 30 employees on your company roll. So, your organization is coverable under both ESI & EPF Act. But, if you dont comply the same, the depts can recovered both the contribution amounts along with interest form the employer itself.
So, it will better for your company to take coverage under both the Act.
As all your branches are in same state, you need not to take Sub-Code in ESI. But, in future if you open a branch out of the state, then in such case for that branch, you will have to take a sub-code under ESI. Whereas, for EPF you can maintain in a single code.

Dear Seniors,
I had generated the PF challan (ECR) on 10th of May-14 (PF for the month of Apri-14) but due to some unavoidable circumstances I was unable to submit the payment against Challan till 25th May -14. On 26th May-14 when I go to the bank to submit the payment the bank officer says that your challan has expired and you have create a new challan.
I know that we should submitted the payment till 20th of the May-14 after that it will be submitted with a penalty charge.
My question is this that "Is there any time period after which the ECR (Challan) get expired"?
Kindly make it clear?
