Dear Seniors, Can half day earned leave be taken? If not, what is the reason for not allowing half day EL? Can you pls explain? Thanks and regards, Mini

Please refer your leave policy, the terms must have mentioned that half EL cannot be availed. In general terms EL can be taken for not less than 3 days, in some companies the employees can avail half day i.e. 3.5 days, but in certain companies you cannot avail.

I cannot give you specific reason for that, some companies does not allow half day system at all, since it is cumbersome to calculate the No. of days for Salary purpose.

Saji has given one reason for not permitting employees half day earned leave. I have also tried to find out whether there is any other reason. This is what occurred to me.Normally the leave policies of the companies and statutorily, the Factories Act or Shops Act of the states link the computation of earned leave to the number of days in full which an employee actually worked and they treat any fraction of the day for which an employee worked is also treated as full day for crediting earned leave for full day. This apart Sec.79(4) of the Factories Act also states that while calculating earned leave of a worker on the basis of one day for 20 days of actual service,,any fraction of leave for half day or more shall be treated as full day only. Therefore when you are getting the benefit of full day leave even for working half day, you will loose too one full day leave even though you attended office for half day.You will loose as much you gain is the principle of equity that must probably governing this practice.However if the leave policy of any company or any state law provides for such facility of only deducting half day's leave for half day's attendance,the same can be made available to the employee covered by such policy or the law. This is my view only I have not come across any case law on this issue. if some one has it he can enlighten us.Any other view is welcome.

Dear Sir,
The Earned Leave can be taken not less than 3 days that too it should be taken in 3 times in a year. That means one should apply in advance before one week to take such leave. Hence taking half day EL is not possible as per the Act.
But in practice, with the union agreements, some managments are liberalized the EL rules and one or two days and half days EL also be allowed by the management to keep the industrial as cordial in day to day smooth operations of the factories/establishments.

There are no rules but the policies of the companies. If a person does not have any other leave balance in his/her account, he/she will eat the PL/EL only. what a big deal if he/she was allowed to half day EL/PL in stead of LOP. This is not a subject to debate much. It is the decision of company management and flexible towards its employees.

Dear all, For half day purposes, Casual Leave (CL) is the best best resort. As the very name indicates, it is meant for casual needs, emergencies and such sudden requirements cropping up suddenly. As opposed to this, Earned Leave Or Previlege Leave or Annual Leave is more a planned affair, that is why prior intimation is called for and is for more duration, it is meant for rest and recuperation for the physical stress and strain undergone. Never heard of any organisation allowing half day EL, if that be so then what is the difference between CL & EL. It is not clear whether Meenu's organisation has CL. Saikumar has explained the legl basis, nothing else could be thought of. KK

Dear All,
Calculation of EL is solely as per Factories Act 1948. The Act is not informing, how to utilise it. It is depends upon the organization to organization, how to use it. Normally when there are CL or SL, then EL is taken in a installment of min. 4 each. But when there is no CL or SL (which is not mandatory by law) then EL can be taken in 1 day or 1/2 day. But again it is depends upon the organization. Hope the point is cleared.

The particular 1/2 days fraction is not permitted in any of the leave rules. But employee can be permitted two and half or three and half or four and half but not particular fraction of only half day,
