I came to know of the ESI maternity leave benefits after my delivery on jan 15, 2014. My delivery was from a non ESI hospital. I have taken 3 months maternity leave, which ends on feb 23, 2014. Can i claim my 12 weeks salary? what are the steps?

Dear Member,
In case you were covered under ESI Act, then you should have got necessary certification before start of maternity leave from your authorised ESI Dispensary.
Now, at this stage, you can consult Insurance Medical Officer of your ESI Dispensary as well as Branch Manager, of appropriate Branch Office of ESIC to which you are attached and discuss the matter with them.
I hope, keeping in view your eligibility from records as well as certificate from private hospital from where you obtained the treatment during maternity leave, the above offices will guide you as may be permissible with rules/regulations at this stage.

Am i now eligible to claim? Means, will i get my 12 weeks salary?? As i havn’t consulted any ESI Dispensaries before my delivery.

Keeping in view the position submitted by you in your comments, I have already suggested you to visit Branch Office of ESIC as well as ESI dispensary and discuss the position.with concerned officers.
I hope you will get proper reply of all the doubts you have raised.
While visiting above offices please donot forget to carry your ESI Identity Card and Medical Certificates etc . issued by private hospital.
