In my company there was maternity leave of 12 weeks is applicable. However I came to know, that the period has been increased by govt., and my company is applying the same. But in my case, I would like to know the date it is applicable to. The reason is I went on maternity leave on 2nd Sept'13 and as per 12 weeks period my leave was till 24th Nov'13. I have extended my leave as LWP, but it would be great if my original maternity leave is extended as per the new amendment

it is applicable for central govt employees, not for pvt organisations.

As per my knowledge read below:
No woman shall be entitled to maternity benefit unless she has actually worked in an
establishment of the employer from whom she claims maternity benefit for a period of
not less than one hundred and sixty days in the twelve months immediately preceding the
date of her expected delivery.
The maximum period for which any woman shall be entitled to maternity benefit shall
be twelve weeks, that is to say, six weeks up to and including the day of her delivery and
six weeks immediately following that day:

Dear Member,
From your remarks, it is not clear whether the "company" in which you are working is covered as establishment or a factory. It has also not been mentioned whether the company in which you are working is covered under any of enactments namely- The Maternity Benefit Act, 1961 or Employees' State Insurance Act, 1948.
It will be more better if complete details are mentioned by you alongwith details of recent amendments, if any. To my knowledge, no amendments have been made recently in any of above major enactments, which provide for maternity benefit/leaves.
