Dear Experts,
Myself joined NGO 15th Aug 12 - Last day of work was 19th Nov 13.
Termination letter recd on 18th Oct 13 and NGO not ready to release Bonus, due to non confirmation of job.
What is the terms and conditions of bonus act say related to this above issue. How many month salary I expect from NGO on last day ?

u r informaton says u job ws not confirmed .
pls confirm the few points.frist
u have appointment letter and r u getting pay on roles u r pf or esi deductions are been done more over u have antecedence record in the company. the bones act says even if u work for 30 working days in year we are eligible for that bonus of that working days only.. so pls check..

Hello Ramesh Tank,
Have you got the Dates RIGHT?
You say your last working Date is 19th Nov 13--we are on 10 Nov, 2013 today.
And you also say, you got the Termination Letter on 18 Oct, 2013--which would mean that you are not working there now.
A bit conflicting.
Can you give better clarity of your ACTUAL situation?

Dear Ramesh Tonk
As per the provisionsof the Payment of Bonus Act 1965 Section 8 prescribes the eligibility for bonus: Every employee shall be entitled to paid bonus by his employer in an accounting year, bonus , in accordance with the provisions of this Act, provided he has worked in the establishment for not less than thirty days in that year .
Act no where states that an employee should have been in confirmed service.
You are definitely entitled to be paid bonus by the employer.

Just to ask, NGO is a non profit organization so how come profit is allocated for Bonus as per POB Act, secondly we are not assured of the employee for what reason the employee has been terminated, was there any fraud/crime committed?? Before coming to any conclusion it is better to know the fact first and then guide, is what I suggest.

Appointment letter with me. No pay roll register record maintain by NGO. But salary credited in to Bank account. NO PF, ESI. Service period yet not confirmed by NGO. Thanking you, Ramesh Tank

One month advance they issue this termination letter ( issue date 18th Oct. 13 & Last date 19th Nov 13). One week to pass this NGO as per their letter. Thanking you, Ramesh Tank

Dear Sir,
Our MD recruited a lady and issue the termination latter to me as one month advance information without Bonus. Meanwhile Our office boy received bonus, detail of calculation as under.
Sept 12 to Mar 13, period considered as Probabation and
April 13 to Oct 13 total 7 month take average salary and 50% on average salary.
ie, suppose 7 month salary 40000/- divided by 7 so average salary was Rs.5714/- and 50% on average salary arrived paid bonus 2857/-
Which clause NGO consider this issue?

The calculation given by you is not as per POB Act, now whatever the MD has given to the office boy may be an ex-gratia, Ex-gratia cannot be demanded by any employee it is given as gesture to the employee. Since your case is termination, the MD thought of not giving the Ex-gratia to you.

Dear Sir,
Only the thing is here he release the amount in the name of "BONUS" instead of Ex gratia.
Normally exgratia will release in the Feb / Mar ie, before financial year end Not Diwali sir. May i correct ?
Only I want to know in this case I am eligible to get Exgratia without confirmation job and one year service.
Shall I fight with Mgmt thro Labour officer ?
